Terms of Service

These Terms of Service ("Terms") govern your access to and use of Idioma, a language translation service operated by GabaNode Lab, LLC ("GabaNode," "we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms.

1. The Service

Idioma provides a JavaScript widget and API that enables website operators ("Customers") to offer machine translation of web content to their end users. Translation is powered by Google Cloud Translation and, optionally, Anthropic's Claude AI for quality review and refinement.

The Service is intended for use by government agencies, nonprofits, and businesses that need to make web content accessible in multiple languages. You must be 18 years of age or older and authorized to act on behalf of your organization to create an account.

2. Accounts and Access

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at accesstreec@gmail.com of any unauthorized access to your account. We are not liable for losses resulting from unauthorized use of your credentials.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in abusive behavior, or fail to pay for services rendered.

3. Billing and Payment

Idioma uses usage-based billing. You are charged based on the volume of translation requests processed on your behalf, measured in characters translated and AI operations invoked. Current rates are displayed on your dashboard.

You may set a monthly spending cap. When your usage reaches your cap, translation requests will be suspended until the following billing period. GabaNode is not liable for any service disruption resulting from reaching a spending cap you have set.

Invoices are generated and charged automatically at the end of each billing period via Stripe. All charges are non-refundable except as required by law or at our sole discretion.

We reserve the right to change pricing with 30 days' notice to registered users. Continued use after notice constitutes acceptance of the new pricing.

4. Acceptable Use

You agree not to use Idioma to:

  • Translate content that is unlawful, defamatory, harassing, or violates any third party's rights
  • Circumvent or attempt to circumvent rate limits, spending caps, or security controls
  • Resell or sublicense access to the Service without written authorization from GabaNode
  • Use the Service in a way that could damage, disable, or impair its infrastructure
  • Submit content that violates applicable privacy laws, including HIPAA, FERPA, or GDPR, without appropriate safeguards

5. Translation Accuracy

Machine translation, including AI-assisted translation, may contain errors. GabaNode makes no warranty that translations are accurate, complete, or fit for any particular legal, medical, or regulatory purpose. You are solely responsible for reviewing translations before using them in high-stakes contexts including but not limited to legal documents, medical instructions, and official government notices.

Customers deploying Idioma on government or healthcare websites should implement human review processes for critical content in compliance with applicable regulations, including Executive Order 13166 (LEP access requirements) and Title VI of the Civil Rights Act.

6. Intellectual Property

GabaNode retains all rights, title, and interest in the Idioma platform, widget code, and underlying technology. Nothing in these Terms transfers ownership of our intellectual property to you.

You retain ownership of your source content. By using the Service, you grant GabaNode a limited license to process your content solely for the purpose of providing translation services.

7. Third-Party Services

Idioma relies on third-party services including Google Cloud Translation, Anthropic, Stripe, and Cloudflare. Your use of these services through Idioma is subject to their respective terms of service and privacy policies. We are not responsible for any failure, outage, or change in service by these providers.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GABANODE LAB, LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNTS YOU PAID US IN THE THREE MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless GabaNode Lab, LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any dispute arising from these Terms or the Service shall be resolved by binding arbitration in accordance with the American Arbitration Association's Commercial Arbitration Rules. You waive the right to participate in a class action lawsuit or class-wide arbitration.

12. Modifications

We may modify these Terms at any time. We will notify registered users by email at least 14 days before material changes take effect. Continued use of the Service after the effective date constitutes acceptance of the modified Terms.

13. Termination

Either party may terminate this agreement at any time. You may cancel your account from the dashboard. Upon termination, your access to the Service will cease and any outstanding balance will be charged. Sections 5–11 survive termination.
